Most people click "I Agree" without reading. But SaaS agreements can affect your data ownership, privacy, and budget. For business software, the stakes are even higher.
Key Terms to Review
1. Data Ownership and Privacy
Who owns your data? What can they do with it?
Good Terms
- You retain ownership of your data
- Data used only to provide the service
- Can export data in standard formats
- Data deleted upon account closure
Red Flags
- "We may use your data for any purpose"
- No data export option
- Data shared with "partners" broadly
- AI training on your data without consent
2. Pricing and Billing
- Auto-renewal: Does it renew automatically?
- Price increases: Can they raise prices mid-contract?
- Usage limits: What happens if you exceed them?
- Refund policy: Can you get money back if unsatisfied?

3. Service Level Agreement (SLA)
What uptime and performance do they guarantee?
- Uptime percentage (99.9% = ~8.7 hours downtime/year)
- Credits or refunds for downtime

4. Termination Rights
How can you (or they) end the relationship?
- Can you cancel mid-contract?
